Moments of Color reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms and Conditions at any time. It is your responsibility to check these Terms and Conditions periodically for changes. Your continued use of the site following the posting of changes will mean that you accept and agree to the changes. As long as you comply with these Terms and Conditions, Moments of Color grants you a personal, non-exclusive, nontransferable, limited privilege to enter and use the site.

At Moments of Color, we are fully committed to respecting your privacy. We only collect personal information when you knowingly provide it. We will not, under any circumstance, distribute your personal information to any third party other than those directly involved in the production of your design. Your information will remain private and confidential at all times and will be removed from our database after your event has taken place or at your request, whichever is earlier.

COPYRIGHT

All copyright is wholly owned and reserved by Moments of Color. A copyright is a property right in an original work of authorship. Copyright is recognised in most contrived of the world by statutory copyright laws. Copyright exists in the expression of an idea, but not the idea itself. Copyrightable expressions can take many forms but are usually categorised as literary, musical, dramatic, pantomime and choreography, pictorial, graphic, sculptural, computer programs, motion pictures and sound recordings. To obtain permission to use Moments of Color copyrighted works, please e-mail or submit your detailed request in writing.

CONTENT

All content included on this site, such as text, graphics, images, photographs, trademarks, logos and artwork including but not limited to the design, structure, selection, coordination, expression,and arrangement of such content, contained on the site is owned, controlled or licensed by or to Moments of Color, and is protected by international copyright laws, and various other intellectual property rights and unfair competition laws.

Except as expressly provided in these Terms and Conditions, no part of the site and no content may be copied, reproduced, republished, uploaded, posted, publicly displayed, translated, transmitted or distributed in any way to any other computer, server, web site or other medium for publication or distribution or for any commercial enterprise, with Moments of Color's express prior written consent.

LINKS TO OTHER WEBSITES

Links to third party web sites on the Moments of Color web site are provided solely as a convenience to you. If you use these links, you will leave Moments of Color's site. Moments of Color is not responsible for any of these sites, their content or their usage of your personal information. We encourage you to read the legal notices posted on these other web sites, including their privacy policies.

ELECTRONIC COMMUNICATIONS

When you visit Moments of Color or send e-mails to us, you are communicating with us electronically. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

PRICES

Prices are initially displayed in Australian Dollars and are converted to your chosen currency at the current exchange rate at time of purchase. All prices include Australian GST of 10%, which is deducted at checkout for international orders. All prices are subject to change and availability.

PAYMENT

Full payment of your order is payable prior to going to print or before any design work is undertaken. No goods will be despatched until full settlement of your account has been made.

COLORS/FINISH

On screen colors may appear slightly different from the printed version due to variations in monitor calibration.

Unless a Pantone color is specified, we do not guarantee the colors of your printed products will match what you see on screen. We use the highest quality materials in the production of our designs so if you are unsure of the final result, please request a sample pack.

DELIVERY

Within Australia, we deliver your goods to you via Australia Post® or reputable national couriers. All overseas deliveries are by international courier, with delivery trackable on the internet. As a signature is required upon receipt of your goods, we cannot deliver to P O Box addresses. Please ensure that the address you supply for delivery is one where someone is available during the day to sign for the goods. We take great care packaging your goods to ensure they reach you in perfect condition and therefore cannot be held liable for any damage whatsoever caused by third parties or be held liable for any delay in delivery by third parties.

PROOFS

Throughout the design process, we will email you electronic proofs to review and comment on. Once we have agreed on a design format, we will send you a physical proof by mail where possible. Due to the fact that Moments of Color use professional printing presses, a physical proof is not always available and we will advise you where this applies. Final signoff of all artwork is required by you prior to production.

ERRORS

At Moments of Color, we endeavour to be error-free. If, however, you discover an error or omission in your printed artwork which was not on the version signed off by you, we will reprint your design at no expense to you. If the error was on the proof you signed off, your design will be reprinted at your expense. It is the client's responsibility to ensure all text is correct at time of printing.

RETURNS

Customer satisfaction is very important to us.

NON-PERSONALISED GOODS

Non-personalised products can be returned to Moments of Color with a copy of your receipt within 21 working days from receipt of your products.

Please choose carefully, as I do not give refunds if you simply change your mind or make a wrong decision. You can choose between a refund, exchange or credit where the goods are faulty, have been wrongly described or are different from the sample sent to you. Returns may take 2 weeks minimum to process and notification will be by email. Postage & packaging costs are not refundable.

PERSONALISED GOODS

Due to the nature of custom artwork, I do not give refunds unless the error or omission is a fault of Moments of Color. If the error was on the proof you signed off, your design will be reprinted at your expense. It is the client's responsibility to ensure all text is correct at time of printing.

Returns may take 6 weeks minimum to process and notification will be by email. Postage& packaging costs are not refundable.

CUSTOM MAPS

No refunds will be given once your first draft has been emailed to you due to the design work already undertaken.

CHANGES TO YOUR DESIGN (personalised printed goods only)

We allow you to change your custom printwork at any time prior to final sign off and production, with a maximum of five rounds of changes. Additional changes will incur a fee of $55 AUD per round of changes so we encourage you to review your artwork carefully to avoid these additional charges. No charges will be made where our designer has not made the specific changes outlined in your correspondence to us.
